Illegal property occupation (Okupas) has posed a significant risk for property owners in Spain for many years. In December 2024, the Spanish Congress approved an important reform aimed at significantly speeding up eviction procedures and strengthening property rights.

Especially for private owners, investors, and foreign buyers, the new Okupa law provides greater clarity and legal certainty.

What does the new Okupa law regulate?

The reform focuses on cases of unlawful entry and illegal use of properties. Its goal is to simplify judicial procedures and avoid long waiting periods.

Fast-track procedures for illegal occupation

A key element of the reform is the introduction of fast-track court procedures. These cases can now be resolved within approximately 15 days, drastically reducing timelines that previously lasted months or even years.

Faster eviction and immediate possession

After filing a claim, an eviction ruling can be issued within about one month. If the owner requests immediate possession, the occupants must prove a legal right to stay within five days. If they fail to do so, a forced eviction is ordered.

Police can intervene sooner

Thanks to a clearer definition of in flagranti, the police can now act more effectively within the first 48 hours following an illegal occupation. This early phase is crucial to prevent escalation.
