When is my property considered a tourist rental?

1. When does my property qualify as a Tourist Rental – “Viviendas de Uso Turístico” (VUT)?


  • If you rent out your entire apartment or house to holiday guests (not individual rooms)
  • Rntal periodup to 10 consecutive days
  • Required are::

·       an urban planning suitability report (informe urbanístico)

·     the exact cadastral reference

·     and registration in the Tourism Register, which must be renewed every 5 years

2. Regular residential rental (from 11 days) – seasonal rental


  • From 11 days rental period, the tourist regulation no longer applies, but the LAU (Ley de Arrendamientos Urbanos
    the Spanish Urban Rentals Law.
  • these rental contracts are considered regular residential rental agreements with all the rights and obligations
       for tenants and landlords (e.g. termination periods, contract duration, rent adjustments).
  • They are suitable for people who want to use the property as their usual residence.

3.  Long-term rental


  • Also regulated by the LAU
  • Typically, these are contracts of at least 6 or 12 months, which can be extended to 5 years (for private
        landlords) or 7 years (for corporate landlords, e.g. companies or funds), if the tenant wishes.
  • After the agreed period has expired, the contract is automatically extended for further annual periods until
     the maximum legal duration is reached.

  • The tenant has special protection against termination – the landlord can only terminate under certain conditions (e.g. own use).
